Terms & Conditions for GeoSwiftSOS

1. Acceptance of Terms

By downloading, installing, or using the GeoSwiftSOS mobile application ("the App"), you agree to be bound by these Terms & Conditions. If you do not agree, do not use the App.

2. Description of Service

GeoSwiftSOS is an emergency assistance application that sends an SMS containing your location to contacts you have chosen. It offers two ways to trigger that message:

  • Manual SOS — you press the SOS button; a short countdown gives you the chance to cancel before the message is sent.
  • Fall detection — when enabled, the App monitors the accelerometer in the background. If it recognises a pattern consistent with a fall, it starts a countdown with an audible alarm and sends the SOS unless you cancel.

The App is a support tool only and does not replace official emergency services.

Always contact official emergency services (e.g. 112) in life-threatening situations.

3. No Guarantee of Emergency Response

We make no guarantees that:

  • SMS messages will be delivered successfully
  • Messages will be received on time
  • Emergency contacts will see them or respond
  • The App will function without interruption

Delivery of SMS messages depends on mobile network availability, signal strength, your carrier, and device functionality — none of which are under our control.

4. Limitations of Fall Detection

Fall detection is based on accelerometer readings and is inherently approximate. You acknowledge and accept that:

  • It may fail to detect a real fall. Soft landings, gradual collapses, falls while seated, and falls where the phone is not carried on the body may go unrecognised.
  • It may trigger when you have not fallen. The App provides a countdown with a cancel button precisely because false triggers are possible.
  • It cannot work if the phone is not with you, is switched off, has an empty battery, lacks an accelerometer, or if the feature is switched off.
  • Android may stop background monitoring under battery optimisation, aggressive power-saving modes, or manufacturer-specific task management.
  • The sensitivity setting changes how readily detection triggers. Lower sensitivity reduces false alarms but increases the chance of a missed fall; higher sensitivity does the opposite.

Fall detection must never be treated as a medical device, a monitoring service, or a substitute for supervision or care.

5. User Responsibility

You agree that you are solely responsible for:

  • Correctly configuring your emergency contacts, and verifying the setup using the App's test message function
  • Informing those contacts that they have been listed and what to do if they receive an alert
  • Maintaining a working mobile network connection and sufficient signal coverage
  • Keeping your device charged, and allowing the App to run in the background if you rely on fall detection
  • Granting and keeping the permissions the App needs in order to function
  • Choosing a sensitivity setting appropriate to your circumstances

The App must not be relied upon as the sole method of seeking help.

6. Proper Use

You agree not to:

  • Use the App for false alarms or misuse
  • Send emergency messages without a legitimate reason
  • Use the App in any unlawful manner

We are not responsible for any consequences arising from misuse. Note that outgoing messages are ordinary SMS and may be charged by your carrier at their standard rates, including while roaming.

7. Permissions

The App requires the following device permissions to function:

  • Location — to include your position in the emergency message
  • SMS — to send that message without opening another application
  • Notifications — to show monitoring status and the cancellable countdown
  • Foreground service — to keep fall detection running while the screen is off
  • Sensors, vibration and wake lock — to detect falls and alert you

The App does not request access to your contact list. Choosing someone from your phonebook uses the Android system contact picker, which hands over only the contact you selected.

By using the App you grant permission for these features to operate as described in the Privacy Policy.

8. Battery Consumption

Fall detection must keep the accelerometer active while your screen is off, which consumes noticeably more battery than normal use. This is a technical requirement of the feature, not a defect. We recommend enabling it when you need it rather than leaving it on permanently.

9. No Data Collection

The App operates entirely on your device and does not collect, store, or transmit personal data to our servers or to third parties. All data remains on your device. See the Privacy Policy for details.

10. Limitation of Liability

To the maximum extent permitted by law, Aurel Design shall not be liable for:

  • Any direct or indirect damages
  • Failure to send, deliver or receive emergency messages
  • Failure of fall detection to recognise a fall, or a false detection
  • Delays or interruptions in service
  • Any injury, loss, or damage resulting from use of or reliance on the App

Use of the App is at your own risk. Nothing in these Terms excludes liability that cannot lawfully be excluded.

11. Availability and Updates

We may modify or discontinue the App at any time, and may release updates that change functionality. We are not obligated to provide continuous support or updates.

12. Intellectual Property

All rights, title, and interest in the App, including design, branding, and content, remain the property of Aurel Design. You may not copy, modify, or distribute the App without permission.

13. Termination

We reserve the right to terminate or restrict access to the App if these Terms are violated.

14. Changes to Terms

We may update these Terms from time to time. Updated versions will be posted, and continued use of the App constitutes acceptance of the changes.

15. Governing Law

These Terms are governed by the laws of Croatia and applicable international laws.
